James River Association challenging Virginia coal ash permit

The James River Association says it's going to legally challenge a state permit allowing millions of gallons of coal ash wastewater into its namesake river.

The Southern Environmental Law Center announced the decision Wednesday to move ahead with a court appeal of a permit issued last month by the State Water Control Board. Dominion Virginia Power is seeking to discharge 350 million gallons of wastewater into the James from its Bremo Power Station in Fluvanna County.

The SELC is also challenging a similar permit allowing Dominion to discharge coal ash waste- and storm-water from its Possum Point Power Station in northern Virginia. The discharge would be into a creek that feeds the Potomac River.

Dominion is discharging the water as it moves to close coal ash impoundments at power plants.
